When a brand name is registered under the provisions of a specific law to secure legal protection, it becomes a trade mark. After registration of a brand name the competitors can't market their products under similar brand name. It is always in the interest of a marketing company to secure legal protection for its brands in the form of trade mark.

When the conducive conditions are prevailing for branding company's products and it is having ambitions plans of marketing. In this situation it will be in the interest of marketing company to get its proposed brands registered under the provisions of "Trade Marks Act." Otherwise unregistered brands can be used by other marketers. If the company go ahead to promote its unregistered brands, and in case if it is rejected in the registered process, then entire promotional expenditure will be futile. The marketing company should thoroughly study the registration procedure to get its brand duly registered under the specified act.
